What’s New:

We are writing to explain an upcoming regulatory change in requirements to California’s Proposition 65 (“Prop 65”) warnings. The State of California has established a list of chemicals present in consumer products that are known to cause cancer, birth defects, and/or reproductive harm. Prop 65 requires retailers to give individuals who live in the state of California a clear and reasonable warning that these chemicals are present in products before knowingly and intentionally exposing the person to that harm.

Key Changes To Comply With Prop 65 By Law:

Updated warnings are required for products manufactured after August 30, 2018.
Warnings must now be provided prior to the customer completing the purchase, even if the product is already labeled with an on-product or packing slip warning.
Warnings must include (1) the most-prominent chemical (if present), (2) list its potential harm (e.g., cancer, birth defects, and/or reproductive harm), (3) use bold text stating “WARNING,” (4) be identified with a caution symbol (), and (5) link to OEHHA’s Proposition 65 information page: www.P65Warnings.ca.gov.
An example of a compliant warning is as follows:

WARNING This product can expose you to [name of chemical], a chemical known to the State of California to cause [cancer, birth defects, and/or other reproductive harm]. For more information go to www.P65Warnings.ca.gov/product.
As a reminder, on-product or packing slip warnings remain a requirement under the law. Those warnings do not require chemical identification and may be shortened to include just the potential harm. An example of a compliant on-product or packing slip warning is as follows:

WARNING – Cancer - www.P65Warnings.ca.gov/product.

Next Steps:

To meet these requirements, Suppliers must provide Bluestem Brands with the name of the most prominent Prop 65 chemical found during testing in products manufactured after August 30, 2018.

Suppliers are responsible for ensuring that their products are labeled and are otherwise compliant with Prop 65 warnings. If Suppliers determine that any products they previously supplied to Bluestem Brands require a Prop 65 warning, they are solely responsible for supplying warnings. Inspection, approval, or assistance by Bluestem Brands regarding Suppliers’ warnings or warning methods does not relieve Suppliers from any of their obligations to comply with Prop 65 and their duty to defend, indemnify, and hold harmless Bluestem Brands if the compliance of their products is challenged.

More detail on this process will be outlined in a future communication on or before June 1, 2018.
