Generally Accepted Practice: Employees who accrue points, be they airline, hotel or loyalty points from a retailer, are usually free to spend those points for personal use. The points accrue to the employee who either traveled or made the purchases or stayed in the hotel etc. The value of the points should not be included as income in the US. (It gets a little trickier in Canada - sorry). The IRS Position: Consistent with prior practice, the IRS will not assert that any taxpayer has understated his federal tax liability by reason of the receipt or personal use of frequent flyer miles or other in-kind promotional benefits attributable to the taxpayer's business or official travel. The New Headache: By the way, never on my own would I have come up with this. The problem our reader encountered was that one of her organization's employees used the points they had accumulated to pay for something that was reimbursable. They then asked to be reimbursed for the cost of the item. This was the employee's way of converting points into dollars. Solution: Let me preface this by saying I am not a tax attorney, so this is only my opinion - not an absolute tax ruling. I would think that if the person were reimbursed those funds, the amount would have to be included in their year-end income and would be taxable. But more importantly, this is something I would not permit. It opens the door to all sorts of nightmares. What's more, not permitting this should be spelled out explicitly in the travel policy. A reader called w= ith the following quandary regarding points. I'll share my reaction and the= n give you a chance to sound off. But before I do, we have compiled all the= commentary offered by our readers on the invoices without invoice number d= ilemma into a special report. = Generally Accepted Practice: Employees who accrue poi= nts, be they airline, hotel or loyalty points from a retailer, are usually = free to spend those points for personal use. The points accrue to the emplo= yee who either traveled or made the purchases or stayed in the hotel etc. T= he value of the points should not be included as income in the US. (It gets= a little trickier in Canada - sorry).

= The IRS Position: Consistent with prior practice, the= IRS will not assert that any taxpayer has understated his federal tax liab= ility by reason of the receipt or personal use of frequent flyer miles or o= ther in-kind promotional benefits attributable to the taxpayer's business o= r official travel. The New Headache: By the way, never on my own w= ould I have come up with this. The problem our reader encountered was that = one of her organization's employees used the points they had accumulated to= pay for something that was reimbursable. They then asked to be reimbursed = for the cost of the item. This was the employee's way of converting points = into dollars.

Solution: Let me preface this by saying I am no= t a tax attorney, so this is only my opinion - not an absolute tax ruling. = I would think that if the= person were reimbursed those funds, the amount would have to be included i= n their year-end income and would be taxable.

But more im= portantly, this is something I would not permit. It opens the door to all s= orts of nightmares. What's more, not permitting this should be spelled out = explicitly in the travel policy. The reason for spelling it out is to avoid= the problem in the future. What do you think? Have you encountered this at= your organization?
