Who is eligible for travel pay? Nonexempt employees under the Fair Labor Standards Act are eligible for compensation for the time they spend traveling. The FLSA, 29 C.F.R.&sect;785.39, states travel time associated with overnight stays is generally considered compensable work time when the business travel cuts across the nonexempt employee's normal work hours, regardless of what day of the week the travel takes place. However, exempt employees are not covered under the FLSA.

In this 10-minute video our speaker, Jackie A. Sexson, reviews recent litigation regarding whether an employee is exempt or not. The key issue in many instances is whether an employee is engaged in travel as part of the employer's principal activity or for the convenience of the employer. Laws differ between exempt and nonexempt employees.
