In light of President Trump=E2=80=99s increased focus and emphasis on =E2=
=80=9CMade in America,=E2=80=9D a better understanding of current regulatio=
ns regarding country of origin is important. Under the current Federal Trad=
e Commission (FTC) guidelines, a product may be advertised as =E2=80=9CMade=
 in USA=E2=80=9D if =E2=80=9Call or virtually all=E2=80=9D of the parts and=
 processing significant to the product are of domestic origin.

Manufacturers may find compliance with the legal requirements for labeling =
and advertising domestic products under the restrictive FTC guidelines is t=
ough; however, the guidance does allow flexibility in some situations. Acco=
rding to the Office of Textiles and Apparel (OTEXA), the FTC allows a produ=
ct that is completely manufactured in the United States, and comprised of m=
aterials primarily from the United States, to be described as =E2=80=9CMade=
 in USA=E2=80=9D if it only has a =E2=80=9Cvery small amount of foreign con=
tent.=E2=80=9D However, manufacturers may find compliance with the legal re=
quirements for labeling and advertising in this situation tricky as the amo=
unt of foreign content that the FTC finds permissible is not clearly define=
d. In situations where the product=E2=80=99s foreign content is truly negli=
gible, this approach may be viable. FTC guidelines permit a company to adve=
rtise a product as =E2=80=9CMade in USA=E2=80=9D by softening or =E2=80=9Cq=
ualifying=E2=80=9D the claim so that the labeling clearly suggests that the=
 product has foreign and domestic materials =E2=80=93 for example, that the=
 product is =E2=80=9CMade in USA of U.S. and imported parts.=E2=80=9D Howev=
er, there remains ambiguity in the FTC=E2=80=99s guidance on what types of =
=E2=80=9Cqualified=E2=80=9D claims are permissible.

Manufacturers in California must comply with the California statute on =E2=
=80=9CMade in USA.=E2=80=9D The state has amended its statute to bring it i=
n line with FTC guidelines and now allows manufacturers to advertise a prod=
uct as =E2=80=9CMade in USA=E2=80=9D as long as the foreign components of t=
he product =E2=80=9Cconstitute not more than 5 percent of the f=C3=ACnal wh=
olesale value=E2=80=9D of the product, or if the manufacturer can show that=
 it cannot produce or obtain the foreign components from a domestic source =
and those components =E2=80=9Cconstitute no more than 10 percent of the f=
=C3=ACnal wholesale value=E2=80=9D of the product.
